1. Introduction
Welcome to Contract Jobs, a digital platform operated by Akal Information Systems Limited (“AKAL”, “we”, “our”, or “us”).
Contract Jobs is an online platform designed to facilitate connections between job seekers, recruiters, employers, and partners for contract, temporary, consulting, part-time, or other employment opportunities.
The platform includes a structured talent database known as CJDex, which enables authorised recruiters and employers to discover candidate profiles for recruitment purposes. By accessing or using the platform, you agree to comply with and be bound by these Terms of Use and our Privacy Policy.
If you do not agree with these Terms, you should not access or use the platform.
2. Eligibility
To use Contract Jobs, you must:
- be at least 18 years of age
- have the legal capacity to enter into a binding agreement
- provide accurate and truthful information during registration.
By using the platform, you confirm that you meet these eligibility requirements.
3. Platform Role
Contract Jobs is a technology platform operated by Akal Information Systems Limited that facilitates connections between candidates, recruiters, employers, and partners for employment and contract opportunities.
AKAL may assist in sourcing candidates, facilitating recruitment processes, and connecting candidates with potential employers or clients through the platform.
In certain cases, AKAL may also provide staffing, workforce management, or payroll services, under which candidates may be employed or engaged directly by AKAL and deployed to work with client organisations. In such cases, the terms of employment or engagement will be governed by the applicable employment agreement, staffing agreement, or service contract.
Except in such staffing or service arrangements where AKAL is the employer or contracting entity, any employment relationship or contractual engagement arising through the platform is generally between the candidate and the hiring organisation or client.
4. User Accounts
Users may be required to create an account to access certain features of the platform. Users agree to:
- provide accurate and up-to-date information
- maintain the confidentiality of their login credentials
- notify AKAL of any unauthorized use of their account.
Users are responsible for all activities conducted under their account.
AKAL reserves the right to suspend or terminate accounts that violate these Terms.
5. Job Seekers (Candidates)
Candidates may create profiles and upload resumes or professional information on the platform. Such information may be stored within the CJDex talent database and may be accessible to authorised recruiters, employers, or partners for recruitment purposes.
By submitting information on the platform, candidates acknowledge that:
- their profiles may be viewed by recruiters and employers seeking potential candidates
- the information provided must be accurate and lawful
- they have the right to share all information submitted.
Candidates agree not to upload content that is false, misleading, unlawful, defamatory, or in violation of the rights of others.
6. Recruiters and Employers
Recruiters, employers, and partners may use the platform to identify and connect with candidates for recruitment and related purposes.
By accessing candidate information through Contract Jobs or the CJDex talent database, recruiters and employers agree that they will:
- use candidate information solely for legitimate recruitment and related purposes
- comply with applicable employment, labour, and data protection laws
- maintain confidentiality and security safeguards for candidate data
- provide accurate and lawful job information.
Recruiters and employers shall process candidate personal data obtained through the platform only for legitimate recruitment purposes and in accordance with applicable data protection laws.
Recruiters and employers are responsible for hiring decisions and employment relationships arising from positions offered through the platform.
Where candidates are employed directly by AKAL under staffing arrangements, the applicable employment or engagement terms will be governed by separate agreements between the candidate and AKAL.
7. Acceptable Use
Users agree not to:
- post inaccurate or misleading information
- impersonate another individual or organisation
- upload unlawful or harmful content
- attempt to gain unauthorized access to the platform
- misuse personal data obtained through the platform.
Violation of these rules may result in suspension or termination of access.
8. Protection of Platform Data and Database
Users may not:
- scrape, extract, copy, or harvest data from the platform using automated tools
- download or compile candidate information in bulk
- create independent recruitment databases using data from the platform
- use platform data to train artificial intelligence or machine learning systems without authorization.
The CJDex database and associated platform data are proprietary assets of AKAL, and unauthorized use may result in suspension of access and legal action.
9. Communications
By using the platform and providing contact details, users agree that AKAL may communicate with them regarding:
- job opportunities
- recruitment processes
- account notifications
- platform updates.
Such communications may occur through email, phone calls, SMS, or messaging platforms such as WhatsApp, and may involve automated communication systems used for recruitment engagement.
Users may opt out of certain communications where applicable.
**10. Use of AI and Technology Tools ** Contract Jobs may use automated systems and technology tools to support platform operations, including:
- resume parsing and candidate profile structuring
- job matching algorithms
- AI-assisted recruitment tools
- automated messaging or dialer systems.
These tools assist in improving platform functionality and recruitment processes. Final hiring decisions remain the responsibility of recruiters or employers.
11. Marketing and Advertising
AKAL may promote Contract Jobs and related services through marketing and advertising campaigns on third-party platforms including social media platforms, professional networks, search engines, and other advertising networks.
Users interacting with such advertisements may be redirected to the Contract Jobs website and may voluntarily submit information through forms or registrations.
Information collected through such interactions will be handled in accordance with the Privacy Policy.
AKAL does not sell personal data to advertisers.
12. Intellectual Property
All platform content, including software, design, logos, trademarks, text, and graphics, is owned by or licensed to Akal Information Systems Limited and is protected under applicable intellectual property laws.
Users may not reproduce, distribute, or modify platform content without prior written permission.
13. Data Protection and Privacy
The collection and processing of personal data on Contract Jobs are governed by the Privacy Policy and applicable laws including the Digital Personal Data Protection Act, 2023. By using the platform, users acknowledge that their personal data may be processed for recruitment and platform-related purposes as described in the Privacy Policy.
By creating an account or submitting personal information on the platform, users acknowledge that they have read the Privacy Policy and consent to the processing of their personal data as described therein.
14. No Employment Guarantee
Contract Jobs and CJDex provide a platform to facilitate connections between candidates and recruiters or employers.
While AKAL may assist in sourcing candidates or facilitating recruitment processes, AKAL does not guarantee:
- job placements
- interviews
- employment offers
- contract engagements.
Hiring decisions and employment terms are determined by the hiring organisation or, in cases where AKAL provides staffing services, by AKAL in accordance with the applicable employment or engagement agreement.
15. Indemnity
Users agree to indemnify and hold harmless Akal Information Systems Limited, its directors, employees, affiliates, and partners from and against any claims, damages, liabilities, costs, or expenses arising from:
- misuse of the platform
- violation of these Terms of Use
- violation of applicable laws
- misuse of personal data obtained through the platform (as per DPDP Act.2023)
- recruitment or employment decisions made by recruiters or employers
- disputes between candidates and employers arising from engagements facilitated through the platform.
16. Limitation of Liability
To the maximum extent permitted by law, Akal Information Systems Limited shall not be liable for:
- hiring decisions made by recruiters or employers
- accuracy of job postings or candidate profiles
- employment terms offered by hiring organisations
- disputes, claims, or disagreements between candidates and recruiters or employers
- workplace conduct, compensation disputes, or contractual disagreements arising from employment engagements facilitated through the platform
- interruptions, technical failures, or service disruptions.
Any disputes relating to employment arrangements between candidates and hiring organisations must be resolved directly between those parties.
Where candidates are employed by AKAL under staffing arrangements and deployed to client organisations, workplace conditions and operational supervision at the client location may be managed by the client organisation, and AKAL’s responsibilities will be governed by the relevant employment or service agreements.
17. Suspension or Termination
AKAL may suspend or terminate access to the platform if a user:
- violates these Terms
- engages in fraudulent or unlawful activities
- misuses platform services or data.
Users may discontinue use of the platform at any time.
18. Changes to These Terms
AKAL reserves the right to update or modify these Terms of Use at any time. Updated terms will be published on the website and will become effective upon posting. Continued use of the platform constitutes acceptance of the revised Terms.
19. Governing Law and Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of India. Any disputes arising from the use of the platform shall be subject to the jurisdiction of the courts located in New Delhi, India, unless otherwise required by applicable law.
